    ALLISON IZU REWARDS TERMS AND CONDITIONS

    THESE ALLISON IZU REWARDS TERMS AND CONDITIONS ("ALLISON IZU REWARDS Terms and Conditions") INCLUDE A CLASS ACTION WAIVER AND REQUIRE BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES. DETAILS ARE SET FORTH BELOW. THESE ALLISON IZU REWARDS TERMS AND CONDITIONS SET FORTH IMPORTANT INFORMATION, INCLUDING RESTRICTIONS. BY PARTICIPATING AS SET FORTH BELOW, YOU AGREE TO THESE ALLISON IZU REWARDS TERMS AND CONDITIONS, INCLUDING ANY CHANGES MADE FROM TIME TO TIME.

    What is ALLISON IZU REWARDS?

    Allison Izu Rewards is a loyalty rewards program offered by Allison Izu, LLC. ("Allison Izu"). You can enroll in the Program by providing your first name, last name, email address, and mobile phone number.

    Who is eligible to participate in the Program?

    Participation in the Program as a Member is available to any United States resident (including any resident of a U.S. Territory) who is able to provide a unique and valid email address and mobile phone number that belongs to them. Corporations, groups, and associations are not eligible to participate in this Program.

    How can I receive points?

    To receive points as a Member, you must self-identify as a Member when making a purchase by providing your mobile phone number at checkout online or to your Stylist in store.

    From time to time we may offer additional opportunities to earn points.

    How many points will I receive for each purchase?

    As a Member, if you have self-identified, you will receive one point for every dollar in eligible Net Purchases, except as set forth below. "Net Purchases" means purchases less returns; discounts; purchases made with a Gift Card; and any applicable sales tax charged in connection with a purchase.

    Additionally, from time to time, bonus points opportunities may be made available to Members (e.g., birthday rewards or triple points events).

    What are the limitations on earning points or accessing other Program benefits?

    If you return an item and received points for that purchase, those points will be deducted from your account balance. This may result in a negative points balance.  Certain limitations and exclusions apply to earning bonus points, as follows:.

    Bonus points opportunities cannot be combined for use in a single day. This means if you schedule a Personal Double Points Day (if you are eligible) during a bonus points event, you will receive the amount of the bonus points in lieu of the double points. If you choose to participate in the bonus points event, you will be able to re-schedule your Personal Double Points Day.

    Points and Rewards are not transferable and have no cash value.

    We reserve the right to make bonus points and other promotional offers available to select Members. Additional restrictions may apply to any of the benefits offered under the Program.

    When do my points and benefits expire?

    Allison Izu Reward points received but not yet redeemed to issue a reward to you will not expire.

    From time to time, Allison Izu may offer a Member an opportunity to earn or receive a Reward that varies in terms and conditions from our standard reward, as detailed above. These rewards will be identified when the offer is presented and when the reward is issued. These rewards may have varying expiration dates, redemption values, specific locations for redemption, and other terms and/or restrictions that deviate from our standard rewards. 

    How do I use my alterations benefits?

    Basic alterations are available to all Members with enough points, provided that items being altered must have been purchased at regular price from Allison Izu or allisonizu.com. Please see a stylist for more information on how many points are needed for your alteration needs.

    As a Member, how do I use my Personal Double Points Days and Bonus Points Events benefits?

    The Personal Double Points Day benefit allows you to select a day to earn double points on all Net Purchases at Allison Izu using your Allison Izu Rewards.

    Please note, the Personal Double Points Days benefit is not cumulative as you progress through the Program. This means, for example, if you are at a Status where your Personal Double Points benefit is one (1) day, and you progress to a Status that provides for three (3) days, and you already used one (1) day, you will have two (2) days left.

    Periodically we may offer you opportunities to earn bonus points on your Allison Izu purchases.

    How do your Event benefits work?

    Eligible Members may receive invitations to exclusive shopping and fashion events hosted by Allison Izu and other select benefits (collectively “Event(s)”). These Events are not predetermined and are developed throughout the Program benefit year at Allison Izu’s sole discretion. An opportunity to participate in these Events is not guaranteed and may be restricted due to limited dates, times, locations, and/or capacity. Participation in an Event may require a purchase at Allison Izu or an additional expense. Complete details for these Events, including any applicable limitations or restrictions, will be sent to selected Members prior to the Event in an invitation or other communication.

    What will Allison Izu do with my email and other personal information?

    Personal information you provide to Allison Izu in connection with the Program will be handled in accordance with Allison Izu's Privacy Policy found online at AllisonIzu.com. When you enroll in the Program and provide us your email and mobile phone number, you may also be enrolled to receive marketing emails from us. You may change your marketing email preferences at any time by clicking on the link found at the bottom of our marketing emails. You will, however, continue to receive transactional messages from us regarding the Program.

    Additionally, your mobile phone number is your unique identifier as a Member and must be provided at checkout to earn points on eligible Net Purchases. Because we use your mobile number and email address to identify you as a Member and notify you of Program benefits, you must ensure that both are accurate and current.

    Verifying your mobile number requires the receipt of and response to an automated text message to the mobile number you provided at the time of Program enrollment. If you consent, Allison Izu and its affiliates and service providers may also use your mobile number to text you, and make autodialed/prerecorded calls.

    When are Program points and/or benefits forfeited?

    If you close your Member account or if Allison Izu terminates your participation in the Program. Upon the death of the Member, all unused Allison Izu Points and benefits associated with the individual’s Program Status are forfeited.

    Will the Program change?

    We reserve the right to terminate, change, limit, modify these Allison Izu Terms and Conditions or the Program at any time and in any way (including our right to discontinue or change the benefits or change the expiration date of points earned under the Program, or to adjust the number of points earned for each dollar in Net Purchases) with or without notice. To the extent required by applicable law, we will give you notice if we end the Program or make a major change to it. It is possible you may not be able to receive enough points to redeem for a Note if we discontinue this Program or merge this Program into another rewards program. We also reserve the right to cancel your participation in the Program, in the event of fraud, abuse of Program privileges, or violation of these Allison Izu Terms and Conditions, and at our discretion. It is your responsibility to visit allisonizu.com/terms to review the most up-to-date Terms and Conditions. Your continued participation in the Program will constitute your acceptance of the most-recent Terms and Conditions governing the Program.

    What are the general terms applicable to the Program?

    You are responsible for any tax liability related to your participation in and/or your purchase of any of the benefits associated with the Program.

    These Allison Izu Terms and Conditions will be governed by the laws of the state of Hawaii, without regard to any conflict of law provisions. If any part of these Allison Izu Terms and Conditions is found to be void or unenforceable under applicable law, all other parts of the Allison Izu Terms and Conditions will still apply. All dollar amounts referred to in these Allison Izu Terms and Conditions are in U.S. Dollars.

    Allison Izu may choose not to enforce, or to delay the enforcement of, any of your obligations or Allison Izu’s rights, remedies, or limitations under these Allison Izu Terms and Conditions. However, no such delay, nor choice to not enforce, shall constitute a waiver of that obligation, right, or remedy.

    Allison Izu Points are not transferable and may not be combined among Members or conveyed by any means to anyone, including through a Member's estate, and may not pass to a Member's successors and assigns. Accrued Allison Izu Points do not constitute property of the Member. Accrued Allison Izu Points are not transferable by the Member upon death, as part of a domestic relations matter, or otherwise.

    Many of the benefits associated with the Program are offered exclusively through Allison Izu. However, in some cases, we may contract with independent contractors to administer these benefits, including but not limited to the issuance of travel documentation, administrative services, and travel reservations. We do not own or control the independent contractors used to administer these benefits. Neither we, nor these independent contractors nor our respective subsidiaries, maintain control over the independent suppliers used to provide accommodations or services as part of fulfilling these benefits. We and our independent contractors do not assume responsibility for any travel or other services provided by any independent supplier. You release us, our independent contractors, and our respective subsidiaries from any responsibility and liability for any loss, injury, damage, accident, delay, inconvenience, or irregularity that you or any other person may suffer due to any cause relating to the Program or the use of any facilities, services, or goods in connection with any travel or other service provided by any independent supplier.

    To access certain benefits associated with the Program, you agree that you may be asked to provide personal information about yourself, such as your name, address, email address, and phone number and that the information you provide will be disclosed to merchants and other third parties as necessary to obtain these benefits. We and our independent contractors have no control over, and no responsibility or liability for, the use by any merchants or other third parties of your personal information or any other information that such parties independently obtain from you or that is given to such parties to process your transactions or fulfill your benefits. You should check their privacy policies before entering into any transaction with them to obtain these benefits. We will protect your information as set forth in the "Your Privacy Rights" link.

    What should I do if I have a dispute?

    Please contact our Service Center at 1.888.246.8720 if you have a dispute regarding the Program.

    YOU AGREE NOT TO BRING AN ALLISON IZU DISPUTE AGAINST US IN A CLASS ACTION, REPRESENTATIVE ACTION OR SIMILAR PROCEEDING IN COURT OR ARBITRATION. YOU ALSO AGREE NOT TO BRING AN ALLISON IZU DISPUTE AGAINST US ON BEHALF OF ANY OTHER PERSON, AND YOU AGREE THAT NO OTHER PERSON MAY BRING AN ALLISON IZU DISPUTE AGAINST US ON YOUR BEHALF. YOU MAY NOT JOIN AN ALLISON IZU DISPUTE IN A SINGLE ARBITRATION WITH AN ALLISON IZU DISPUTE OF ANY OTHER PERSON. IF YOU TRY TO ASSERT ANY ALLISON IZU DISPUTE IN A CLASS ACTION OR SIMILAR PROCEEDING, WE CAN REQUIRE THAT IT BE RESOLVED IN INDIVIDUAL (NON-CLASS) ARBITRATION. THIS PARAGRAPH IS REFERRED TO AS THE "CLASS ACTION PARAGRAPH."

    YOU AGREE NOT TO BRING AN ALLISON IZU DISPUTE AGAINST US IN A PRIVATE ATTORNEY GENERAL ACTION IN COURT OR ARBITRATION.

    This arbitration provision is governed by the Federal Arbitration Act (the "FAA"). The arbitrator(s) must follow: (1) the FAA; (2) all other applicable substantive law (except when contradicted by the FAA); (3) any applicable statute of limitations; and (4) rules as to valid claims of privilege. Further, the arbitrator(s) shall issue a written decision including the reasons for the award upon either party's request. The decision of the arbitrator(s) will be final and binding, except for any appeal right under the FAA.

    This arbitration provision will survive the termination of the Allison Izu Terms and Conditions or your relationship with us. If any part of this arbitration provision is found to be void or unenforceable under applicable law, all other parts of this arbitration provision and of the Allison Izu Terms and Conditions will still apply; except that if the Class Action Paragraph is found to be void or unenforceable in any way, this entire arbitration provision shall be deemed void and shall not apply, but all other parts of the Allison Izu Terms and Conditions will still apply.

    Indemnification

    By agreeing to participate in the Allison Izu Program, you release Allison Izu, Inc., its subsidiaries and affiliate entities, and their respective, directors, officers, employees, and agents (the “Released Parties”) from all liability with respect to the misdirection or misuse of any Allison Izu points, or the use of any Allison Izu benefits by an individual other than the Allison Izu member who earned the Allison Izu benefits. You further agree, through your agreement to participate in the Program, to release the Released Parties from and against any and all claims, damages, losses, liabilities, and other expenses (including, without limitation, attorney’s fees) relating to your participation in the Allison Izu Program, use of Allison Izu Points and Allison Izu Notes, use of products or experiences offered or made available under the program, or agreement to these terms.

    The Released parties make no warranty or condition, expressed or implied, including, but not limited to, any warranties or conditions of merchantability or fitness for any particular purpose with respect to the Allison Izu Program, membership in the Allison Izu Program, or any products or services related to the Allison Izu Program.
